(APEG) Membership, APEG Essentials, APEG Foundations of Financial Planning or any course, benefit, or feature on this website; you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained on this site are protected by applicable copyright and trademark laws. Your compliance with regulatory authorities or other entities which you are contractually bound to including the SEC; FINRA; your Broker/Dealer; your Registered Investment Advisor; insurance companies, insurance agencies, or financial branches; is YOUR responsibility. APEG makes no representation that it has approval from any of the above entities with regards to the material on this site.

 

2. Use License

  14. Any course on this site will expire at the earlier of completion of the course, at the discontinuance of payment to APEG or 180 days after course enrollment. No Refunds or partial refunds will be issued for user’s failure to complete a course. 
  15. If payment for this course is funded or arranged by an employer or third-party sponsor other than the user, user authorizes APEG to share attendance, completion data, quiz and exam results with employer and/or sponsor.  User / Member agrees to hold harmless Advanced Planning Educational Group, Inc. (APEG), its officers, directors, shareholders, employees, contractors and/or agents for any issue arising from the sharing of this information, including, but not limited to, loss of employment or compensation.
  16. Licensing Rights to G.O.A.L.S. Planning Support Tools for Members of APEG shall be granted a non-exclusive and non-transferable license (the "License") to use APEG’s Planning Support Tools (“Tools”) in their practice subject to the terms and conditions listed below.  
  17.  "Tools" include:   First Meeting Booklet: “An Overview of Goal-Based Financial Planning”;  Initial Interview: “About You and Goals, The Initial Interview”;   Annual Review: “About You and Your Goals, Annual Review”;  Goal Identifier: “A Roadmap to our Relationship” ; and any other marketing material APEG may offer now or in the future.      
  18. Title, copyright, and intellectual property rights of the Tools remain exclusively with APEG. Intellectual property rights include the look and feel of the Tools. By agreeing to these Terms, Licensee acknowledges that their interest in the Tools is a License for use only and is not in any way a transfer of ownership rights to the Tools.   
  19. The rights and obligations under these Terms are granted to the Licensee only.   The Licensee may not transfer or assign any of the rights or obligations granted under these Terms to any other person or legal entity.    The Licensee may not make available the Tools for use by one or more third parties.    
  20. APEG Software/Tools may not be modified, reverse-engineered, or de-compiled in any manner through current or future available technologies.   
  21. APEG makes no warranty expressed or implied regarding the fitness of the Tools for a particular purpose or that the Tools will be suitable or appropriate for the specific requirements of the Licensee.  
  22. APEG does not warrant that use of the Tools will be uninterrupted or error-free.   
  23. No user support or maintenance is provided as part of these Terms.
  24. Membership and/or enrollment DOES NOT INCLUDE individual consultation or support in practice management or case design.
  25. These Terms will be terminated, and the License forfeited where the Licensee has failed to comply with any of the terms of this Agreement or is in breach of this Agreement.    On termination of this Agreement for any reason, the Licensee will promptly destroy the Software/Tools or return the Software/Tools to APEG.   These Terms do not create or imply any relationship in agency or partnership between APEG and the Licensee.  
  26. Information about a specific client situation along with state law can vary widely based on the specific facts involved.   Given the changing nature of laws, rules and regulations, and the inherent hazards of electronic communication, there may be delays, omissions or inaccuracies in information contained in the services offered through this site by APEG.   Accordingly, the information provided by this Service is provided with the understanding that the authors and publishers are not herein engaged in rendering legal, accounting, tax, or other professional advice and services, regardless of their professional licensure or designations.    As such, it should not be used as a substitute for consultation with professional accounting, tax, legal or other competent advisors.   Users of the Service/Tools must comply with their professional licensure duties for performing their due diligence in developing, presenting, and implementing their recommendations to their client(s).

Intellectual Property:  The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of APEG and its licensors.  The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.   Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of APEG.   You are granted a non-exclusive, non-transferable, revocable license to access and use www.apegcommunity.com and apegcommunity.teachable.com strictly in accordance with these terms of use.  As a condition of your use of the Service, you warrant to APEG that you will not use the Service for any purpose that is unlawful or prohibited by these Terms and Conditions.  You may not use the Service in any manner which could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service.   You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Service.   All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of APEG and/or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights.  You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.   You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found in the Service.   
  30. APEG content is not for resale.   
  31. Your use of the Service does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content.   
  32. You will use protected content solely for your personal use and will make no other use of the content without the express written permission of APEG and the copyright owner.  
  33. You agree that you do not acquire any ownership rights in any protected content.  
  34. We do not grant you any licenses, express or implied, to the intellectual property of APEG or our licensors except as expressly authorized by these Terms.   
  35. GENERAL REFUND POLICY: APEG will issue a refund of unused service calculated on a monthly basis. The refund will apply to unused months only. No partial monthly refund is available. Upon request for refund, the user shall immediately discontinue use of service, all licensure rights shall immediately terminate and user shall return or destroy any materials associated with the service or licensure rights. Refund requests shall be made via email to [email protected] or mailed to APEG's address of record found on this site.
  36. If a user declines the Terms of Use, the Privacy Policy or any other required acknowledgement, AND the user has not used any portion of any of the services included in their purchase, they will receive a full refund. Use of any service will require adherence to the, GENERAL REFUND POLICY. User must make the request for full refund in the same manner as found in the GENERAL REFUND POLICY.
